What Is the SHOP Marketplace?

The SHOP (Small Business Health Options Program) marketplace is the ACA's group health insurance exchange for small businesses. In Florida, SHOP is operated through healthcare.gov. Purchasing your group health plan through SHOP is the only way to qualify for the Small Business Health Care Tax Credit — worth up to 50% of premiums for for-profit businesses and 35% for nonprofits.

SHOP is not a separate insurer. The same Florida Blue, Ambetter, Aetna, and Oscar plans available outside SHOP are also available through SHOP — the difference is that SHOP enrollment creates the eligibility pathway for the federal tax credit.

Who Qualifies for the SHOP Tax Credit?

Your business must meet all three criteria:

The plan must also be purchased through the SHOP marketplace at healthcare.gov. Buying the same plan outside SHOP does not create credit eligibility.

How the Credit Is Calculated

Business Size (FTEs)Average WageMax Credit (For-Profit)
1–10 FTEsUnder $31,00050% of premiums paid
11–24 FTEs$31,000–$61,999Phases out proportionally
25+ FTEsAnyNo credit
1–10 FTEs (nonprofit)Under $31,00035% of premiums paid

The credit phases out as FTE count rises above 10 and as average wages rise above $31,000. The maximum 50% credit requires both fewer than 10 FTEs and average wages under $31,000. The credit is available for two consecutive tax years.

Credit Value Example: A Tampa restaurant with 8 FTEs, average wages of $28,000, and $36,000/year in employer premium contributions receives a $18,000 federal tax credit — reducing the net cost of offering health insurance to $18,000 annually, or $1,500/month. For businesses near the I-4 corridor competing for workers against large employers, this makes group coverage highly cost-effective.

How to Calculate Your FTE Count

FTEs are calculated differently for SHOP than for ALE (Affordable Care Act employer mandate) purposes. For SHOP credit:

Example: 4 full-time employees (2,080 hrs each) + 4 part-time employees (1,040 hrs each) = 8,320 + 4,160 = 12,480 hours ÷ 2,080 = 6 FTEs.

How to Enroll Through SHOP in Florida

The process:

SHOP enrollment is available year-round for new small group plans — there is no annual enrollment window restriction for employer coverage. We handle the SHOP application and healthcare.gov enrollment as part of our standard service at no extra cost.

Claiming the Credit

The SHOP tax credit is claimed on IRS Form 8941 (Credit for Small Employer Health Insurance Premiums) and attached to your annual business tax return:

The credit is nonrefundable for for-profit businesses (cannot exceed tax liability) but can be carried back one year or forward 20 years. Nonprofits receive a refundable credit against employment taxes.

Frequently Asked Questions

Can I use the SHOP credit every year indefinitely?
No. The SHOP tax credit is available for a maximum of two consecutive tax years. After two years, the credit expires regardless of business size or wages. You continue to qualify for all other tax benefits (§162 deduction, Section 125 FICA savings) after the SHOP credit period ends. Many Florida small businesses use the two-year credit period to offset the initial cost of setting up benefits and building employee enrollment.
Does buying through SHOP limit which plans I can offer?
In Florida, most major carriers participate in SHOP — Florida Blue, Ambetter, Oscar, and others. The plan options are substantially the same as outside SHOP, though the specific plan menu varies slightly. In most cases, the SHOP plan selection is broad enough that choosing SHOP enrollment doesn't meaningfully restrict your carrier or plan options. We compare SHOP and non-SHOP options for every qualifying business so you can see if the credit value outweighs any plan selection differences.
My Florida LLC has 12 employees and average wages of $45,000. Do I get any credit?
Yes, a partial credit. With 12 FTEs and $45,000 average wages, your credit phases out from the maximum. The phase-out reduces the 50% maximum by 2 percentage points per FTE above 10 (so 4 points for 12 FTEs) and by proportional reduction for wages above $31,000. For a business like yours, the effective credit rate would be roughly 25–35% of premiums. We calculate the exact credit as part of your quote comparison. Even a partial credit significantly reduces the net cost of providing coverage.
